BY VISITING hbbornandproud.co.nz, YOU HEREBY CONSENT TO THE FOLLOWING TERMS AND CONDITIONS.

The terms “I”, “ME”, “WE,” “US,” and “OUR” refer to HBBORNANDPROUD. As used herein, HBBORNANDPROUD  shall include their respective affiliates and agents. The term the “SITE” refers to HBBORNANDPROUD.CO.NZ. The terms “USER/S,” “YOU,” and “YOUR” refer to SITE visitors, customers, members and any other USERS of the SITE. These Terms and Conditions apply to YOU and all SITE visitors, customers, and all other USERS of the SITE (whether accessed through a computer, mobile device, or mobile application. These Terms and Conditions establish the legally binding terms which apply to YOUR use of the SITE or SERVICE. By accessing the Site or SERVICE, YOU acknowledge reading and understanding these Terms and Conditions and agree to be bound by them in their entirety (including but not limited to the Intellectual Property Rights, Governing Law, and Arbitration provisions below), whether or not YOU create an account.

ACCOUNT CREATION AND SECURITY

In order to use the SERVICE, YOU may be required to provide information about yourself including YOUR name, email address, and other personal information. YOU agree that any such registration information YOU give to HBBORNANDPROUD will always be accurate, complete, and at all times up to date. YOU may not impersonate someone else or provide account information or an email address other than YOUR own. YOU are responsible for maintaining the confidentiality of YOUR account information, and YOU are solely responsible for all activities that occur under YOUR account. YOU agree to immediately notify HBBORNANDPROUD of any disclosure or unauthorized use of YOUR account.

ORDER CONFIRMATION

WE will email YOU to confirm the placement of YOUR order and with details concerning directory delivery. In the event that there is an error in this email confirmation, it is YOUR responsibility to inform US as soon as possible.

CONTENT POSTED BY YOU IN THE SERVICE

  1. YOU are solely responsible for any CONTENT that YOU POST, upload, publish, link to, transmit, record, display or otherwise make available (hereinafter, “POST”) on the SITE or SERVICE. YOU may not POST as part of the SERVICE, any offensive, inaccurate, incomplete, abusive, obscene, profane, threatening, intimidating, harassing, racially offensive, or illegal material, or any material that infringes or violates another person’s rights (including intellectual property rights, and rights of privacy and publicity).
  2. By POSTING CONTENT as part of the SERVICE, YOU automatically grant to HBBORNANDPROUD an irrevocable, perpetual, non-exclusive, transferable, sub-licensable, fully paid-up, worldwide right and license to (i) use, copy, store, perform, display, reproduce, record, play, adapt, modify and distribute the CONTENT, (ii) prepare derivative works of the CONTENT or incorporate the CONTENT into other works,, and (iii) grant and authorize sublicenses of the foregoing in any media now known or hereafter created. YOU represent and warrant that any POSTING and use of YOUR CONTENT by HBBORNANDPROUD will not infringe or violate the rights of any third party.

EFFECT OF HEADINGS

The subject headings of the paragraphs and subparagraphs of these Terms and Conditions are included for convenience only and shall not affect the construction or interpretation of any of its provisions.

RECOVERY OF LITIGATION EXPENSES

If any legal action or any arbitration or other proceeding is brought for the enforcement of these Terms and Conditions, or because of an alleged dispute, breach, default, or misrepresentation in connection with any of the provisions of these Terms and Conditions, the successful or prevailing party or parties shall be entitled to recover reasonable attorney’s fees and other costs incurred in that action or proceeding, in addition to any other relief to which it or they may be entitled.

SEVERABILITY

If any term, provision, covenant, or condition of these Terms and Conditions is held by an arbitrator or court of competent jurisdiction to be invalid, void, or unenforceable, the rest of these Terms and Conditions shall remain in full force and effect and shall in no way be affected, impaired, or invalidated.

ASSIGNMENT

These Terms and Conditions bind and inure to the benefit of the parties’ successors and assigns. These Terms and Conditions are not assignable, delegable, sublicenseable, or otherwise transferable by YOU. Any transfer, assignment, delegation, or sublicense by YOU is invalid.

CANCELLATIONS, REFUNDS & RETURNS

As each event is a one-off monthly event, cancellations will not be accepted. No shows will be charged.

If you’re unable to attend the event and you find out after ticketing closing, you can not transfer to another event.

THE ITEM I RECEIVED IS NOT THE ITEM I ORDERED

Provided the item is unopened and in ‘mint’ condition I will replace the item or provide a full refund. To receive YOUR  replacement or refund YOU must return the original item to HBBORNANDPROUD and process YOUR refund or replacement within 2–3 days of receiving your item.

THE ITEM I ORDERED WAS DAMAGED IN TRANSIT

If your item was damaged between leaving the HBBORNANDPROUD warehouse and arriving at your delivery address, you will receive a full refund or replacement. OUR designated Courier will collect the damaged parcel from your address, along with the original packaging, and once the damage has been verified your return will be processed. This process can take up to one week. Please note that for your claim to be accept you must retain the original packaging for your item(s), and the original packaging material used to deliver YOUR order.

THE ITEM I ORDERED ARRIVED FAULTY OR DIDN’T WORK AS INTENDED

Please arrange with HBBORNANDPROUD to return the item for testing. If we confirm that the item was damaged before leaving the HBBORNANDPROUD warehouse, or was faulty out of the box, YOUR item will be repaired or replaced by HBBORNANDPROUD free of charge. A refund may also be offered in some circumstances.

THE ITEM I ORDERED DID NOT ARRIVE

If YOUR item did not arrive the first thing to do is request a “track and trace” on YOUR  item from HBBORNANDPROUD, please call 027 858 4152

Regrettably, HBBORNANDPROUD nor my designated Courier are able to refund or replace items that have been lost, damaged or stolen after being delivered to YOUR property. If YOU are concerned about leaving YOUR  items un-attended we recommend using the “signature required” option that is presented in the Checkout

I’VE CHANGED MY MIND AND NO LONGER WANT THE ITEM I ORDERED

Change of mind returns can be processed as long as the item is unopened, in mint condition and returned within 7 days. The shipping for the return will also be at the cost of the buyer. Once we have the item in hand we will assess the item and if everything checks out OK YOU will receive an account credit to spend at HBBORNANDPROUD.
